SWFL SHARKS RUGBY CLUB, INC. 2023/2024 ATHLETE PARTICIPATION WAIVER AND RELEASE OF LIABILITY

In consideration of being allowed to participate in a SWFL SHARKS RUGBY CLUB, Inc., youth or high school rugby season and/or related events and activities, the undersigned:

Acknowledges and fully understands that each participant must be fully and properly registered and have all required waivers signed before participating with any SWFL SHARKS RUGBY CLUB, Inc. member team or club; and
Acknowledges and fully understands that each participant will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses might result not only from their own actions, inaction, or negligence, but also the action, inaction or negligence of others, the rules of play, or the condition of the premises or of any equipment used; and
Assumes all the foregoing risks and accepts personal responsibility for the damages that may follow such injury, including permanent disability or death; and
Releases, waives, discharges and covenants not to sue SWFL SHARKS RUGBY CLUB, Inc. its affiliated clubs, their respective administrators, directors, agents, coaches, and other employees including Athletic Trainers, Referees, or volunteers of the organization, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and/or leasees of premises used to conduct the event, all of which are hereafter referred to as “Releasees,” from any and all liability to each of the undersigned, his or her heirs and next-of-kin for any and all claims, demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise.

Further, consent is hereby granted to SWFL SHARKS RUGBY CLUB, Inc., its Athletic Trainers, and its member clubs and teams to initiate any medical or first aid treatment for the undersigned participant in the event of a significant injury or illness. The undersigned understands that a reasonable attempt to locate a parent and/or guardian of the participant will be made in the most expeditious manner possible. In the event a parent and/or guardian cannot be reached, the undersigned understands that any treatment necessary for the best interest of the participant may be initiated.

SWFL SHARKS RUGBY CLUB, INC. PHOTO AND VIDEO RELEASE

I understand that SWFL SHARKS RUGBY CLUB, Inc. from time to time produces promotional material in relation to its programming. I understand that as a participant in and / or a spectator of SWFL SHARKS RUGBY CLUB, Inc. events my child(ren) may be included in videotapes and / or photographs taken at such functions. Therefore, without reservation or limitation, I, in my own behalf and on behalf of my minor child(ren), hereby assign, transfer and grant to SWFL SHARKS RUGBY CLUB, Inc., its successors, assignees, sponsors, any television networks, and all other commercial exhibitors the right to photograph and/or videotape my child(ren) and to utilize such photographs and videotapes and the minor’s name, face, likeness, voice and appearance as part of SWFL SHARKS RUGBY CLUB, Inc. in advertising, on SWFL SHARKS RUGBY CLUB, Inc.’s website, and in or for any promotional events sponsored by SWFL SHARKS RUGBY CLUB, Inc. I further understand that neither SWFL SHARKS RUGBY CLUB, Inc., nor any third party is under any obligation to exercise any of the foregoing rights, licenses and privileges.
